Whenever the College learns of information to the effect that disruptive demonstrations, involving the participation on college grounds by students and/or staff, are to occur in the foreseeable future, regardless of whether such information is based upon fact or rumor, the College shall immediately alert the Chief of Police of the City of Arkansas City to such information.
In the meantime, the College will make every effort to determine if the information is correct. The College, upon ascertaining that such a situation is to occur, will seek to identify the organizer or organizers for the purpose of discussing solutions which will avert the occurrence.
In the event that the discussions prove fruitless and that such disruptions as 1) unlawful assembly and loitering on College grounds; 2) disruption of normal operation of the general College program; or 3) unauthorized walkout do take place, the participants will be warned that they risk immediate suspension from their relationship with the College if they fail to disperse. Suspension of pay for participating staff members remains in effect unless and until lifted by the Board of Trustees.
If the situation continues past the time limit imposed, all participants will be considered as suspended on the grounds of trespassing and shall be subject to such action as may be dealt outside trespassers.
Should there be a need to summon assistance from civil police authorities, the College has the authority to issue such a call and to determine when to make the issuance.
In the absence of the person identified in the foregoing paragraph, any other staff members should then have full authority to maintain peaceful assembly. Staff members should, however, inform themselves of these situations as fully as possible before acting.
Participants shall be responsible for property damages and physical injury,and shall be subject to civil and criminal action as the situation dictates.
Participants who are suspended, whether students or staff members, shall be granted timely hearings before a Board following an appropriate notice of such hearing. The President of the College, shall, after the conclusion of any unusual situation, designate the membership of this Board which shall consist of both staff members and students.
Complete minutes of each hearing shall be recorded. Appellants shall be permitted access to legal counsel at their own expense, and counsel shall have the right to accompany clients at their hearings. The Board shall also be entitled to have legal counsel present at all hearings,Appeals, if any, to the Board's rulings shall be to the Board of Trustees of the College.
The Board of Trustees of the College shall reserve the right to withhold or to release the names of those suspended persons whose appeals have been denied.
This policy supplements but does not supplant other College policies governing conduct of staff members and students.
