The actual hearing outcomes are to be kept confidential as protected by the Family Educational Rights and Privacy Act. This Federal act guarantees student access to their personal records and protects a student’s right to privacy by limiting the transferability of their records without their consent. In addition, all members of the UDC have signed an oath of confidentiality that prohibits them from discussing any details of the hearing with anyone outside of the UDC. Files will be kept for six years following the completion of all required sanctions assigned to the most recent violation of the Code of Conduct. After six years, files will be destroyed except in the most serious of situations, such as sexual assault. In those situations, it will be up to the discretion of the Judicial Affairs officer as to when to destroy the files.
